What is Covered by Workers' Compensation?

|

As a worker who has been seriously injured on-the-job, you are probably going to be off your feet and recuperating for some time. It would be unreasonable to expect you to complete your job’s duties until it is safe to do so, but this also means you won’t be going to work and getting a paycheck. This is where the workers’ compensation benefits you deserve kick in.

The average workers’ compensation benefits package will provide money for:

  • Medical treatments: Other than minimal copay amounts, your health insurance combined with your workers’ compensation benefits should eliminate the majority of your medical costs.
  • Missed wages: It is uncommon for workers’ compensation benefits to give an injured worker their full weekly wages. Instead, most will give an amount equal to about two-thirds of what they would normally earn throughout the month.
  • Disability benefits: If you experience total disability due to your injury and cannot safely perform any work at all, you should be given added disability benefits. This may be permanent or temporary, depending on how long doctors expect your disability to last.
  • Job rehabilitation: Your employer may be obligated to rehabilitate you for your job after an accident, or provide retraining to another position with similar benefits and pay. This can be a useful alternative for both you and your employer, as it keeps everyone feeling productive.
  • Death benefits: If an employee is in a work-related accident that is so devastating that they lose their life, surviving family members should be given death benefits to pay for a funeral and burial. Death benefits may also include a lump compensation amount equal to a portion of the wages the decedent should have earned while under the company’s employ had the accident never occurred.

Getting appropriate workers’ compensation benefits is often easier said than done. Employers and their insurers often resist making significant payments to injured workers because that not only costs them money but also acknowledges that they are at least partially responsible for what happened.
