San Bernardino Shooting Victims Face Delayed / Denied Workers' Comp Claims

|

Workers' compensation is intended to provide you with the benefits you need to take care of yourself after you have been injured on the job. In the best case scenario, you would report your accident or injury to your employer and the paperwork would be reviewed and approved by the appropriate individuals. However, this has proven time and time again over the years to not be the way things work.

Although there are laws in place to protect an injured employee's rights to benefits, many workers find that employers and their insurers make the process difficult for them. There are many situations which can lead to the unfair denial or delay of workers' compensation claims,

One example of this is an incident which occurred one year ago in San Bernardino. On Dec. 2, 2015, there was an assault which occurred at a San Bernardino County Health Department event and holiday party. This shooting led to 14 people losing their lives and 22 being severely injured. Many of these injured workers spent days, weeks, and even months in hospitals and rehabilitation centers as a result of the incident.

Many of the survivors of this attack in their workplace suffered from the following:

  • Lasting pain and injuries
  • Medical complications
  • Emotional and mental issues
  • PTSD
  • Rehabilitation
  • Long-term care

One year later, now December 2016, many survivors have had their requests denied for mental health care, medical care, and the medications they need. They feel that both state and county officials did not do enough to help them after being injured in a workplace shooting. While much was done by officials after this incident to help the injury victims, the workers' compensation system is not perfect, especially in extenuating circumstances like the San Bernardino incident.
