Can I Get Workers' Comp for PTSD?

|

When a person experiences a traumatic event such as a car accident, assault, or an accident resulting in the loss of life or limb, the resulting psychological distress may sometimes manifest itself as a long-term condition known as post-traumatic stress disorder (PTSD). Depending on the circumstances, if a person develops PTSD due to a traumatic event which occurs while they are working, they may be able to pursue compensation for their resulting medical expenses and lost wages under their employer’s workers’ compensation insurance.

Workers’ comp claims based on PTSD are allowed in many states. Generally speaking, to be approved, a worker must have experienced or witnessed some sort of traumatic event while acting within the scope of their employment, and that the resulting psychological symptoms interfere with their ability to work. Likewise, claimants must receive an official and formal PTSD diagnosis from a licensed psychiatrist or psychologist.

PTSD can result from any of the following work-related situations:

  • A police officer, EMT, or firefighter responding to a horrific or dangerous situation
  • A construction worker witnessing a co-worker’s severe injury or death
  • A teacher or school administrator witnessing a school shooting

Proving PTSD to an Insurance Company Can Be Difficult

While PTSD can be a very real and debilitating condition, like many other mental disorders and illnesses, providing sufficient proof of its presence and effects to a workers’ comp insurer can be difficult. Since claims related to PTSD can be considered “mental-mental,” meaning that a psychological stimulus results in mental health symptoms, many states have prohibited these claims from being eligible for coverage, with certain others requiring claimants to jump through hoops to receive compensation.

Regardless of whether your claim is payable by an insurance company, the state, or your employer themselves, your allegations of PTSD will likely be closely scrutinized prior to being approved, especially if you have received coverage under workers’ comp before. As such, it is important you obtain a thorough psychological evaluation from a professional mental health specialist and receive documented evidence of your symptoms.
